Personal Data and Processing

PFK+Partner Tax Consultancy and Auditing GmbH & Co KG stores and processes, among other data:

  • Name and address
  • Social security number
  • Gender
  • Tax number and VAT ID
  • Industry affiliation
  • Possible commercial register number
  • Possibly names and social security numbers of children and spouses for claiming allowances and deductions in the context of tax returns
  • Phone number and email address for contact purposes
  • Names and contact details of company contacts
  • Social insurance institution account number and employee provident fund account number
  • Municipal tax number (for local tax purposes)
  • Bank details (for transferring balances from the tax office account and for payroll purposes)

If we also perform payroll accounting tasks, the following data are stored and processed by our partner firm, DSW Wirtschaftstreuhand GmbH:

  • Collective bargaining agreement affiliation
  • Name, address, and social security number of employees
  • Previous employment periods (for correct classification under the collective agreement) of employees
  • Citizenship of employees
  • Gender of employees
  • Possibly bank details of employees
  • Commuting allowance data of employees
  • Possibly names and social security numbers of the children and spouses for claiming deductions in the context of payroll accounting of employees
  • Parental leave and birth dates of employees’ children
  • Possibly reduction of earning capacity according to the Federal Social Office of employees
  • Sick leave data of employees
  • Vacation data of employees
  • Apprenticeship periods of employees

Processing of Data

PFK+Partner Tax Consultancy and Auditing GmbH & Co KG processes your data using BMD software with the support of Microsoft Office. Our servers are located in Austria. Our data is backed up daily in a disk-to-disk-to-tape backup, locally on different media. Currently, cloud backup is not used. Should we decide to secure data backups in the cloud at a later date, we will ensure that only servers in the EU are used for cloud backup, thus ensuring a level of data security comparable to that in Austria.

Confidentiality

PFK+Partner Tax Consultancy and Auditing GmbH & Co KG commits its employees and agents to confidentiality in accordance with § 6 of the Data Protection Act (DSG), § 184 of the WTBG and Article 28(3) of the GDPR in its current version. A separate confidentiality declaration can be requested at office@pfk-partner.at.

Storage Duration

We generally store your personal data until the end of the business relationship for which we have collected your data or until the expiry of the applicable statutory limitation and retention periods; furthermore, until the end of any legal disputes for which the data are required as evidence. Documents related to the examination of money laundering are deleted 5 years after the end of the business relationship.

Applications

PFK+Partner Tax Consultancy and Auditing GmbH & Co KG collects personal data such as name, address, date of birth, or data you have voluntarily provided during the application process (via email, mail, or in person). These data are used exclusively for the application process and are accessible only to the management at PFK+Partner Tax Consultancy and Auditing GmbH & Co KG. If an employment relationship is established, the data stored during the application process are used for pre-contractual measures (preparation of employment contract). After the application process, you will be informed about the status of your application. In the event of an unsuccessful outcome of your application, your data will be kept on file, and you will be informed about future job offers matching your application profile. If you do not wish this, your data will, of course, be completely deleted. If you wish to have your applicant data deleted, please send an email to office@pfk-partner.at.

Our Obligations

Data and Processing

Results PFK+Partner Tax Consultancy and Auditing GmbH & Co KG processes data only within the scope of a written order or contract. If we are required by an authority to disclose your data, we will inform you immediately.

Confidentiality Obligation

All employees of PFK+Partner Tax Consultancy and Auditing GmbH & Co KG are obliged to maintain confidentiality according to Art. 28(3) GDPR and § 6 DSG as well as § 184 WTBG in the current version.

Notification and Reporting

Obligations In the event of a data breach, you will be informed by PFK+Partner Tax Consultancy and Auditing GmbH & Co KG immediately, no later than 48 hours after becoming aware of the breach. If the supervisory authority takes action or measures related to your data, we will inform you immediately.

Security Measures

PFK+Partner Tax Consultancy and Auditing GmbH & Co KG has implemented technical and organizational security measures in accordance with Art. 32 GDPR to meet the requirements. These security measures are kept up to date.

Access and Access Control

All systems are secured with extensive password protection and are subject to an authorization concept that ensures that only authorized persons have access to data. Access to server data is reserved for administrators. Input Control Personal data can only be entered, modified, and deleted by authorized persons. Entries in the customer master data are logged.

Backup Control

It is confirmed that data backups are performed daily and that the operating conditions are monitored. If problems should occur, the employees have been informed what to do in this case. Precautions have been taken to ensure that failures are minimized.

Right of Access (Art. 15 GDPR)

You have the right under Art. 15 GDPR to request information about all data stored about you by PFK+Partner Tax Consultancy and Auditing GmbH & Co KG at any time. Please send access requests to office@pfk-partner.at. We may request further information from you to verify your identity.

Right to Rectification (Art. 16 GDPR)

If we process personal data that you believe is incomplete or incorrect, you may request its correction or completion.
